WARRANTY PROVISIONS IN DETAIL

§1 The agreement:
(1)
An offer is valid for 20 working days from when it is sent. The offer lapses if it is not accepted in writing before the end of this period.
(2)
The price only includes what is expressly mentioned in the order confirmation.
(3)
The prices quoted apply to delivery from the seller’s workshop and exclude transport.

§2 Delivery/performance:
(1)
The time required for the performance of the work shall be agreed upon separately at the time of conclusion of the contract.

(2)
The place of work and delivery is the seller’s workshop. If the seller is to undertake the transport and no written instructions have been received, the means and route of transport shall be chosen at the seller’s discretion.

(3)
If the seller cannot meet the agreed delivery time, the seller is obliged to notify the buyer immediately.

(4)
If the buyer fails to receive/collect the delivery on the agreed day, it shall be stored at the seller’s workshop/warehouse or elsewhere at the buyer’s expense and risk.

§3 Payment:
(1)
The purchase price is due for payment in cash 14 days after the date of delivery.
(2)
If the purchase price is not paid on the due date, interest shall be added at the rate provided for in the Act relating to Interest on Overdue Payments, etc. Additional fees may apply in some cases.

§4 Quality requirements:

(1)
Unless otherwise agreed, the finish of the paintwork will be carried out in accordance with the standards and norms for finished paintwork in the automotive paint industry (FAI).
(2)
As 100 per cent colour matching to the lateral parts is not possible in the case of partial coatings, minor colour deviations must be accepted. Acceptable colour deviations are specified in DIN 6175 part 1: “Colour tolerances in the automotive industry”.
(3)
If materials are to be used which the buyer himself supplies or requires to be used, the seller cannot guarantee the quality of the work carried out.
(4)
A 12-month warranty is provided.

§5 Liability for defects:
(1)
If the paintwork is to be carried out on items that have been pre-treated by others or on an existing treatment, the seller’s liability covers only damage that can be proved to have resulted from the seller’s own work, unless the prior treatment has been manifestly defective.
The seller is obliged to inform the buyer about defective pre-treatment. If the customer still wants the work done, certain reservations will apply regarding the quality.
(2)
The buyer is obliged to inspect the agreed items immediately upon collection/delivery and to notify the seller immediately of any complaints about visible defects.
(3)
The seller’s liability only covers defects that are reported by the buyer within 1 year after the day on which the items were delivered to the buyer.
The seller has the right to remedy any defects found after delivery throughout the liability period.
(4)
The seller’s liability does not include indirect losses such as operating losses, loss of profit, daily fines or other indirect losses or any consequential costs.
(5)
If, in connection with insurance damage, the necessary removal of fender rails, handles, windows, etc. is not carried out by the buyer, we accept no liability for peeling, rust penetration and rust leakage at joints.
(6)
The seller shall not be liable for defects resulting from:
• Mechanical impact, subsequent incorrect treatment of the paint or other effects that cannot be attributed to the paint itself, such as stone chipping.
• Commissioning of the workpieces before the painting has cured sufficiently (including the application of emblems and the like).
• Chemical and thermal effects on the items after delivery, about which the seller is not aware or which are beyond the specifications applicable to the paint.
(7)
No paint factory can supply paint through which water cannot penetrate. If the paintwork has been carried out correctly and the paint thickness prescribed by the paint manufacturer has been applied, the seller cannot be held responsible for any moisture spots. Moisture spots are blisters in the paint layer that can occur after prolonged exposure to moisture.
(8)

Any disputes shall be settled by the FAI’s Board of Appeal.
